The City of Moorpark employs a complaint-based Code Compliance model. When individuals note a problem, they can make an anonymous report to code compliance staff via telephone call (805) 5-17 6232, email (firstname.lastname@example.org) or in person at City Hall. Occasionally, City staff will initiate a case independently when we become aware of a situation that threatens public health or life/safety issues.
Once a complaint has been received, Code Compliance staff inspects the site and researches city files to determine if the complaint is valid. If compliant in determined to be valid, a Notice of Violation is sent to the property owner, informing of the violations seeking the property owner's cooperation in bringing the property into compliance. If compliance is not achieved within the deadline set in first Notice of Violation, a second Notice of Violations is sent, again requesting voluntary compliance. A final Notice of Violation will follow, should compliance not be achieved by the deadline set by the second Notice of Violation.
If a property owner declines fails to comply by the deadline set by the Final Notice of Violation, an Office Hearing will be scheduled in order for the City and the property owner to agree on a compliance plan and a timeline.
If the office hearing does not result in compliance, the matter is then referred to the City Council for authorization for legal action through the city attorney. Even if the matter has been referred to the city attorney, the City always welcomes voluntary compliance. Some matters are resolved by the city attorney action, others are resolved by the court.
Concurrently with City Attorney actions, City staff may issue a Notice and Order to Abate, which requires that the property be brought into compliance by a certain date, or the matter appealed to the City Manager. Failure to comply or appeal may result in the property being recorded as a Nuisance, which clouds the title of the property and will consequently affect any future sale or transfer.
Depending on the nature of the violation, administrative citations may be issued at any point during the compliance process at the discretion of Code Compliance staff.
When a Notice of Violation is prepared, Code Compliance Staff is required to cite the Municipal Code section that is at issue. If a violator disputes the interpretation of the Municipal Code section, or its application, that determination may be appealed to the Community Development Director.
An appeal may take the form of an informal appeal to the Director and could be done through an in person meeting with the Director, or more formally through a written appeal. The decision of the Community Development Director may be appealed to the Planning Commission, upon filing of the required forms and fee. A determination made by the the Planning Commission may, in turn, be is appealed to the City Council, upon filing of the required forms and fee. A determination made by the City Council is final.
Code Compliance staff are authorized by Section 836.5 of the California Penal Code and City Council Resolution No. 91-742 to enforce all sections of the Moorpark Municipal Codes. The City may include other codes, such as the IPMC and various California Building codes in the Municipal Code by adoption.
